Wisconsin Supreme Court enjoins Madison order on in-person classes

The Wisconsin Supreme Court has enjoined the Public Health Emergency Order #9 in Dane County. The order from the public health department stopped all in-person classes in Dane County due to the COVID-19 pandemic. Under this injunction schools could open for in-person classes as early as tomorrow. The court order is attached below. This is a temporary injunction while the court makes a decision on the schools, but the court ruled that the plaintiff in the case is likely to succeed on merits. 

The public health order took effect on August 24, and stopped schools in the county from offering in-person classes to students in grades 3-12. Several suits were filed against the health order, claiming that the health department had no authority to stop in-person classes, and that the rule infringed on the religious rights of private schools.
